General Terms & Conditions
1.1 The benefits given to you in AWS's Standard Warranty are in addition to other rights and remedies you have under law in relation to the products to which AWS's Standard Warranty relates.
The following statement only applies to Australian purchases: Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:
-
to cancel your service contract with us; and
-
to a refund for the unused portion, or to compensation for its reduced value.
You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.
The following statement only applies to New Zealand purchases: Our goods come with guarantees that cannot be excluded under the Consumer Guarantees Act 1993 (CGA). You are entitled to a replacement or refund for a failure of substantial character and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality or fail to comply with another guarantee in the CGA and the failure does not amount to a failure of substantial character.
1.2 Subject to section 1.1 and the terms below, as your Standard Warranty AWS agrees to repair or replace at AWS's cost the AWS product, and any AWS accessory supplied with the product, purchased by you in Australia or New Zealand from a AWS Authorised Dealer when the product does not perform in accordance with the manufacturer's specifications during the Warranty Term specified for the product in the warranty 'Table 1', commencing from the date of purchase. Special Conditions apply under the Standard Warranty to some products as identified in Table 1.
1.3 To make a claim under the Standard Warranty you will need to:
a) If you believe that your product requires warranty assistance please go to the AWS website for self-help guides and support.
For Australia and New Zealand: www.australianwindandsolar.com/contact-us
b) In Australia contact AWS on 1300 736 458 and select 5 for Technical Support to register your claim and provide the details to enable AWS to assess the claim. In New Zealand call +61 3 9645 1356 and select 5 for Technical Support. For both Australia and New Zealand you can also visit the AWS Contact Us page located on our website.
(c) Provide or make the product available to AWS or an AWS Authorised Repairer or as otherwise agreed with AWS. If you are required to return the product to an AWS Authorised Repairer, AWS will provide details of the centre to you. To find the nearest AWS Authorised Repairer, either contact AWS on 1300 736 458 if in Australia, or on +61 3 9645 1356 if in New Zealand or visit the AWS Contact Us page located on our website. If service is on-site or in-home pick-up service, AWS will contact you to make arrangements for on-site service or pick-up.
(d) Please note, you will need to submit proof of purchase (e.g. bill of sale, invoice or purchase receipt) with your claim.
1.4 Products presented for repair may be replaced by refurbished products of the same type rather than being repaired. Refurbished parts may be used to repair the products. Replacement of the product or a part does not extend or restart the Warranty Term.
1.5 If the product presented for repair is capable of retaining user-generated data, you are advised that repair of the product may result in loss of the data.
1.6 The product will be at the owner's risk whilst in transit to and from the AWS Authorised Repairer, unless transported by AWS or its Authorised representatives.
1.8 AWS will bear the expense of transport where transported by AWS or its Authorised representatives. Any other expense of claiming the warranty will be borne by you the customer.
1.9 AWS and its Authorised Service Centres may seek reimbursement of any costs incurred by them when the product is found to be in good working order.
